Terms of Service - Customers

Effective: 8 October 2026

These terms cover use of the daya booking platform, operated by PAP NOÉMI E.V., as a customer: browsing, booking appointments and holding a customer account. By using the platform - registering or booking - you accept them.

Subscribing as a salon? Then the Terms of Service for Salons apply, together with the data processing agreement they contain.

The whole thing in one sentence: daya is software that lets salons offer appointments and customers book them. The service is provided by the salon, not by us. If something is wrong with the haircut, that is between the salon and the customer; if something is wrong with the software, that is ours.

1. Definitions

  • Platform - the daya website, mobile app and the service behind them.
  • Operator (we) - PAP NOÉMI E.V., 1135 BUDAPEST, TATAI UTCA 20..
  • Salon - the business offering appointments on the platform. Our subscribing customer.
  • Staff member - a person using the system on the salon's behalf.
  • Customer (you) - anyone booking an appointment, with or without a registered account.

2. What daya is - and is not

daya is software for beauty salons to take appointments and manage customers. We do not provide beauty services and are not a party to the agreement between a salon and its customer.

It follows that:

  • The salon is responsible for the content, quality, price and performance of the service.
  • The salon sets its cancellation, lateness and no-show rules, and enforces them.
  • You pay for the service directly to the salon; there is no payment on the platform.
  • Complaints about a service go to the salon first. We are responsible for the platform.

The platform is free for customers. Only salons pay a subscription.

3. Your customer account

A customer account is for managing your own bookings. Booking without an account is possible; in that case data is kept for a shorter period (see the Privacy Policy).

Everyone is responsible for keeping their own credentials safe. If you notice unauthorised access, tell us at hello@daya.now.

One email address can hold both a customer and a salon account. These are separate accounts: separately verified, with separate settings and separate notifications. In a customer account you book as a private individual; in a salon account you act on the salon's behalf. Deleting one does not affect the other. See section 2 of the Privacy Notice for details.

4. Your obligations

  • Give accurate details - the salon relies on them to prepare and to reach you.
  • Keep the appointment you booked, or cancel it in good time. Cancellation rules are set by the salon and shown before you book.
  • A salon may add a customer to its own block list, and the system also blocks automatically: if you accumulate the number of late cancellations set by the salon within the salon's chosen window at that same salon, you cannot book there again for the period the salon set. The threshold, the window and the length of the block are the salon's settings, and the salon can lift a block at any time. A block applies only to that salon, we tell you before you start booking, and you are warned before cancelling whenever that cancellation counts as late.
  • Do not upload images you have no right to publish, and do not put information into the questionnaire that the salon did not ask for.

A salon must not ask you for special category data in the booking questionnaire - in particular health data, such as information about illness, allergies, medication or pregnancy; our contract with salons prohibits it. Do not answer such a question. If you come across such a question, report it at info@daya.now; we delete the question and the answers received.

5. Stamp cards and discount codes

Some salons run a stamp card: after a set number of completed bookings they give a reward. The stamps are counted on the platform, but the reward is given and defined by the salon - which service it applies to, how many stamps it takes, and when it can be redeemed. Redemption happens at the salon, and the system deducts the required number of stamps at that point.

A salon may also issue a discount code that you enter while booking. Its validity, size and withdrawal are likewise the salon's decision.

Both are a discount between you and the salon: we provide the bookkeeping for it but are not the party owing it. If a salon discontinues its stamp card, has its account suspended, or ceases trading, stamps collected there cannot be redeemed and we accept no liability for that. Take such matters up with the salon.

6. User content, moderation and reporting

Who owns content. Content uploaded by a salon belongs to the salon; photos you upload remain yours. By uploading, you grant us only the licence needed to store the content and display it within the service - no more, no less. Your photo is used solely to fulfil that booking, never for marketing.

What is prohibited. Unlawful, deceptive or abusive content; content infringing another's rights; unauthorised publication of a third party's personal data; content contrary to the purpose of the service.

Reporting. If you encounter unlawful content on the platform, report it at info@daya.now. We examine reports without undue delay and inform both the reporter and - where we remove content - the user concerned, with reasons. Our decision can be contested at the same address.

7. Acceptable use

Do not use the platform for unlawful purposes, to obtain other users' data without authorisation, for automated bulk querying, to overload the system, or to circumvent its security measures. Do not reverse-engineer the service or build a competing service derived from it.

8. Availability, bug reports and changes

We aim to keep the service continuously available, but we do not guarantee uninterrupted operation. Planned maintenance is announced in advance. We develop and occasionally change features.

Bug reports. If something does not work, you can file a report from the app or the website. The description, any screenshots you attach, your contact details and the technical data needed for debugging (platform, app version) reach us and are used solely to investigate the fault. Each report gets a reference number so it can be traced.

We may amend these terms. Amendments are published, and users are notified of material changes. Continuing to use the platform after an amendment counts as acceptance.

9. Liability

We are liable for the platform in accordance with the law. For customers it is a free software service: we cannot guarantee fault-free, uninterrupted operation, but we fix faults within a reasonable time.

We are not liable for what is not our service or lies outside our control:

  • the service provided by a salon - the salon is responsible for its quality, non-performance, price, or any dispute between the salon and the customer, because the contract is concluded between them (section 2);
  • loss arising from inaccurate or incomplete data you supplied;
  • outages caused by circumstances outside our control that could not be foreseen or avoided.

This section does not limit rights you have as a consumer under mandatory law. It does not exclude or limit our liability for breaches of contract committed intentionally or with gross negligence, by a criminal offence, or causing harm to life, bodily integrity or health.

10. Governing law and disputes

These terms are governed by Hungarian law, excluding its conflict-of-law rules.

As a consumer, this clause does not deprive you of the mandatory protections of the law of your habitual residence, and you may also bring proceedings before the courts of your place of residence. For out-of-court dispute resolution you can turn to the conciliation body of your place of residence or, in another EU Member State, to the alternative dispute resolution body of your place of residence.

For any dispute, write to hello@daya.now first - most matters are settled in one exchange.
